Business transfers, acquisitions and disposals

The Transfer of Undertaking (Protection of Employment) Regulations 2006 (TUPE) are designed to protect the terms and conditions of employees, when a business or contract for services to which they are assigned, changes hands.

TUPE can be a complex piece of legislation. Businesses can easily experience difficulties in identifying whether a relevant transfer for the purposes of TUPE is on the horizon. A clear strategy is needed from the outset as there are expensive penalties for employers who fail to comply with their legal obligations in this area.
