Pharmacy law and medicines management

The law in relation to the commissioning of pharmaceutical services and the prescribing, supply and administration of medicines is wide-ranging and complex. Our specialist team advises on all pharmaceutical and medicines management related issues arising in the context of NHS or independent health care services. Our areas of specialism include:

  • Advising on the NHS (Pharmaceutical Services) Regulations 2005 and all related legislation and guidance with regard to matters such as control of entry, pharmacist terms of service, and the regulation of pharmacists
  • Representing NHS primary care organisations in proceedings before the Family Health Services Appeal Unit arising from the 2005 Regulations
  • Advising on fitness to practise concerns
  • Assisting with the drafting of pharmaceutical needs assessments
  • Advising on public consultation obligations with regard to the commissioning of pharmaceutical services
  • Advising on the commissioning of advanced and enhanced services
  • Advising on the development of local pharmaceutical services and drafting associated contracts
  • Advising on the provisions of the Medicines Act 1968 and associated medicines legislation, including advising on all issues relating to the supply, prescribing and administration of medication
  • Assisting with the drafting of policies and procedures for the storage, management and use of generic and specific drugs
  • Advising on research and clinical trials, and associated contracts
  • Providing advice and support on the funding of drugs and on determining individual funding applications’
