Hill Dickinson has a specialist team handling personal injury and regulatory work in the shipping, transport and offshore industries.
The team’s main areas of work involve defending small, large and multi-party claims on behalf of owners, employers and operators. Such claims can arise from accidents or industrial diseases on board ships and offshore installations and in shipyards, ports, public factories and other places of work.
The personal injury team has an unrivalled reputation in this field. We deal with passenger and crew issues arising from minor incidents on passenger ships right through to major disasters. We have also acted in multi-action litigation arising from personal injury and illnesses such as Novovirus, Salmonella and high-value E. coli 0157.
Recent high-profile cases we have acted on include:
- Calypso
- Sea Diamond
- Explorer
The team is able to deal with all aspects of an accident. This can include on-site investigation and assistance, dealing with the various investigation authorities and handling all proceedings including:
- Inquests
- Civil proceedings
- HSE
- MCA
- Police
- PLA prosecutions
- MAIB and coroners’ investigations
- Judicial reviews
- Public enquiries
In casualties a member of the team will often attend on site with one of our legally-qualified master mariners. This enables all aspects of a situation to be dealt with swiftly and effectively.
We also provide proactive advice and training on health and safety issues. This can include drafting accident report training and procedures, loss prevention and risk assessment and drafting of contractual indemnities. In-house training is provided to crew, officers and management.
Another area of expertise includes providing advice on the Package Travel Regulations 1992. We have specialist experience in drafting booking conditions and conditions of carriage.
We are members of ABTA (Travel Industry Partner Scheme), the Passenger Shipping Association and the European Cruise Ferry Council.
