The Hill Dickinson health team specialises in all mental health issues, including the appropriateness of compulsory detention, the adequacy of and appropriateness of documentation, powers of the mental health review tribunal, conduct of managers’ hearings and advice on health service policies such as restraint of patients, search and discharge.
Areas of expertise include:
- Interpretation and application of the Mental Health Act 1983
- The lawfulness of detention, consent to treatment and funding issues
- A pro-active advisory service on health service policies, including assistance with drafting policies and procedures
- Representation and advice at mental health review tribunals
- Defence of claims for false imprisonment
- Judicial review / habeas corpus cases
- Assistance with training by way of lectures and seminars on specialist topics, including the impending introduction of the Mental Capacity Act 2005
