Employment Law for Marine Clients

 

Hill Dickinson’s team of specialist employment lawyers provides expert counsel and advice to marine clients across the full spectrum of employment law issues. We are aware that our marine clients require advice that often has an international dimension to it and we are able either to provide directly or manage the sourcing of this advice for our clients.

In providing advice, we take a commercial approach which is backed by a detailed understanding of the needs of our clients’ needs and is directed at finding cost-effective solutions that best suit the particular needs of the given client: we are aware that all clients are different and we do not adopt a “one size fits all” approach to the advice we give.

Employment law work that is commonly undertaken for our marine clients includes:

  • Drafting crew agreements and seeking approval for such agreements
  • Drafting executive service agreements, contracts of employment, policies, procedures and handbooks for land based staff
  • Immigration advice for employees of clients who will ordinarily work in the United Kingdom (including obtaining work permits and visas where required)
  • Advice on the operation of United Kingdom and European employment rights for crew and land based staff
  • Advice on the operation and interpretation of executive service agreements, contracts of employment and crew agreements
  • Advice on the operation of disciplinary and grievance procedures, and performance management procedures
  • Advice on the employment aspects of business restructuring and reorganisations (including advice on the operation of the Transfer of Undertakings (Protection of Employment) Regulations 2006, redundancy and dismissal)
  • Conducting employment litigation in the Employment Tribunals and the civil courts
  • Advice on and drafting in relation to the employment aspects of business and company purchases
  • Advice in relation to trade unions, industrial relations and industrial action, including undertaking applications for injunctive relief and/or damages where appropriate in cases of unlawful industrial action
  • Advice in relation to health and safety at work (including managing stress at work issues)
