ACAS Code of Practice on discipline and grievance approved
by Parliament.
Parliament this week approved the ACAS Code of Practice on discipline and grievance. The Code is also supported by non-statutory ACAS Guidance Notes. The Code comes into force on 6 April 2009.
The Code will replace the Statutory Dispute Resolution Procedures and the existing ACAS Code of Practice.
The Code sets out practical guidance and the requirements of fairness when conducting disciplinary or grievance procedures. Whilst it is not mandatory, a failure to follow the Code is likely to increase the chances of a finding against an employer at an Employment Tribunal in certain cases. Failure to comply with the Code by either employer or employee could lead to an increase or decrease in any award made by a Tribunal of up to 25%.
