Last week Beyoncé and Jay-Z gave birth to a little girl called Blue Ivy Carter. If Beyoncé and Jay-Z and their newborn lived in England and Wales Jay-Z would automatically have Parental Responsibility for Blue as he is married to Beyoncé regardless of whether he was on Blue’s birth certificate.
Parental Responsibility encompasses “all rights, duties, powers, responsibilities and authority which a parent of the child has in relation to the child and his property”. Practically speaking this would mean that a parent could liaise with the child’s GP or school and have a right to be consulted regarding medical decisions. Having Parental Responsibility also grants a parent the right to be consulted about decisions such as a child’s surname, religious upbringing and where they go to school.
However, if Beyoncé and Jay-Z were unmarried in England and Wales it would be necessary for Jay-Z to acquire Parental Responsibility. He could do this by:
- Ensuring that he is registered on the birth certificate as Blue’s father
- Marrying Beyoncé
- Entering into a parental responsibility agreement with Beyoncé
- Applying to court for a parental responsibility order
- By obtaining a residence order in his favour
