The aim of the course
We will provide you with a
basic understanding of the legal process in which you are involved,
general guidance to the NHSLA’s requirements for claims handling,
and help as to how to undertake the necessary investigations
required to produce a preliminary analysis (as required by the
NHSLA protocol). The course comprises five full days over a two
month period.
Topics covered will include:
- An overview of the English legal system
- The law of negligence and the anatomy of a claim
- A detailed discussion of the clinical negligence pre-action protocol and its requirements
- Disclosure of case notes and confidentiality
- Assessing case notes, obtaining clinicians’ comments, interviewing witnesses and instructing experts
- A detailed consideration of the NHSLA’s own protocols for claims handling
- Advice on assessing quantum
- General points on how to investigate claims within an organised framework whilst supporting clinicians through what can be a very difficult time
- Although the course is focused on claims handlers who handle legal claims, much of the guidance is of equal benefit to those who are involved in handling NHS complaints.
The course is limited to 25 delegates to promote the maximum opportunity for a general discussion about issues delegates may wish to raise, and for time to assist delegates with the various written exercises that are undertaken as part of the course.
Refreshments and lunch will be provided on each day.
If you are unable to attend on any of the specific dates, you will be given the opportunity to attend the day you have missed on the next run of the course.
Cost
The five day course is £1,500 plus
VAT, including all lectures and written materials (which will
include many working examples and source materials which can be
used for future reference).
Early booking is recommended as places will be allocated on a
first-come, first-served basis.
