The Mental Health Bill is making its way through Parliament with 3rd reading in the House of Commons anticipated in or around October 2025 before it reaches its final stage dealing with any amendments before gaining Royal Assent.

Baljit Dhillon-Sidhu and Caroline Hadfield from our Healthcare and Public Law team discuss the changes to be made to the current ‘nearest relative’ provisions of the MHA 1983, including how a ‘nominated person’ will be identified following the changes to the MHA 1983, the differences between nearest relative and the new nominated person role, what obligations providers will have in relation to a nominated person and how providers can prepare for dealing with the changes in practice.
