Damien is a New Zealander who has lived in Hong Kong since 1995. His law practice comprises a wide range of commercial disputes - both in litigation and arbitration contexts.

Damien specialises in commercial litigation and international arbitration. His practice typically involves:

  • Wide variety of contractual claims
  • Complex cross border debt recovery and damages claims
  • International trade, shipping, and sale of goods disputes
  • Shareholders and joint venture disputes
  • Acting for companies and underwriters defending personal injury claims, including claims arising from incidents on board cruise vessels. 
  • Enforcement of judgments and awards in the PRC and in Hong Kong

Damien also has significant experience with ship mortgage enforcement work, and ship arrests, for both banks and other creditors. The firm's arbitration practice requires Damien to advise in relation to drafting and construction of arbitration references, and enforcement of awards in the PRC and in Hong Kong. Damien sits as an arbitrator and is on the Hong Kong International Arbitration Centre Panel of Arbitrators.

Experience
  • Substantial cargo claim arising from alleged short delivery of, and damage, to a consignment of rice
  • Defending a charterparty claim brought by owners against charterers for damage following the collapse of a crane during discharge operations
  • Instructions by Shanghai lawyers (Wintell) to represent the shipowners to and to arrange for the release of the vessel
  • Representing head owners and in the process of pursuing an unsafe port claim against the time charterers down the charterparty chain
  • Defending the criminal prosecution of the owners and master of the vessel for the alleged use of non-compliant fuel whist berthed in Hong Kong
  • Advising and representing USA-based client on a multi-million US dollar litigation claim against a Hong Kong listed company and its subsidiaries over
  • Advising on legal disputes arising from defective lithium ion batteries supplied by a recently publicly listed PRC manufacturer
  • Acting for European and US companies following internet fraud scams. Liaising with banks and the Hong Kong Police to have the bank account frozen
  • Acting for the Singapore branch of a NYSE listed food trading conglomerate in a high value commodities claim following the wholesale breach of a GAFTA
  • Defending a global insurance company in a High Court action brought by 11 insurance agents in relation to alleged misrepresentation, conspiracy to injure, and breach of contract allegations
