Lucy Probert
Lucy joined the firm in July 2022, having previously been an Associate at Ward Hadaway. Since qualification, Lucy has specialised in providing advice to the NHS and the wider public sector in the commercial field.
Lucy has a particular experience in advising on all manner of contractual arrangements for services, supplies and works. Her procurement practice includes developing procurement processes with clients and preparing a wide range of procurement documents including SQs, ITTs, ITNs, draft contracts, framework agreements and dynamic purchasing systems. In addition, she has provided advice and support in relation to scoring and evaluation processes, award procedures and in relation to potential procurement challenges. Lucy also has extensive experience in advising in relation to complex, long term, multi-party contractual arrangements (including PFI) and has good knowledge of NHS standard form contracting.

- Provided advice and assistance on several collaborative arrangements and partnering agreements between NHS bodies
- Acted for an NHS Foundation Trust on the transfer of mental health services between NHS providers
- Prepared and negotiated contract documentation with private sector suppliers following procurements for the NHS and a utility
- Provided assistance to an NHS Foundation Trust PFI / estates management team to address issues relating to supplier performance for an FM service
- Provided day to day support for procurement teams for NHS bodies, a public utility, and a social housing provider
- Provided advice on potential procurement challenges for NHS contracting authorities, including for a CCG in respect of GP out of hours services
- Prepared a wide variety of procurement documentation including SQs, ITTs, ITNs, award notice and standstill letters
- Negotiated and drafted variations for existing PFI projects, including in respect of amendments to service level specifications
- Acted in relation to two successful adjudications for an in relation to a PFI dispute concerning failures in the estates service
- Acted on a successful adjudication then arbitration in relation to a PFI dispute concerning defects in fire protection measures
