The Mental Health Act 1983 (MHA) and its Code of Practice applies to all providers registered with CQC to assess and treat patients who are detained under the Act. The CQC is responsible for reviewing and monitoring how you as an organisation apply the Act when providing services if this is one of your organisation’s registered activities. If the CQC identify concerns in respect of the use of the MHA, this may trigger further inspection or monitoring activity.
For this reason, it is extremely important that Acute Hospital Trusts can evidence a good working knowledge of the MHA and the procedures to follow, regardless of how frequently the MHA is used. A Trust does not need to be registered to provide care and detention under sections 135 and 136 MHA (places of safety) or if the patient is granted section 17 leave to the Acute Hospital Trust. However, Trusts must be registered if section 5(2) MHA (holding power) is used or if the patient is detained under Section 2 or Section 3 MHA.
It is also important following the introduction of the Mental Health Units (Use of Force) Act that Acute Trusts have awareness of responsibilities and actions required to be in place where they are caring for individuals detained under the MHA.
