The recent judgment in the case of Collyer -v- Mid Essex Hospitals Services NHS Trust [2019] EWHC 3577 should serve as a reminder that it is for the claimant to prove that the injury was caused by negligent treatment and a defendant need not necessarily provide a non-negligent explanation.
