Government response to consultation on draft regulations implementing the Procurement Act 2023 - GOV.UK

On 22nd March 2024, the Government responded to a consultation on the draft regulations that was published by Cabinet Office in two parts in 2023. When the consultations were undertaken and published the then Procurement Bill was still in draft form, only receiving royal assent in October 2023. 

The first part of the consultation focused on understanding the extent to which the drafting of the regulations implements the intent of the policy. Specifically, this largely included areas that require lists and calculations to be used in practice when utilising the Procurement Act 2023. The second part covered transparency, including the notices to be used throughout the procurement lifecycle, and other related matters like the Central Digital Platform. Throughout both the first and second parts of the consultation, the stakeholder opinion was largely positive, which was unsurprisingly mirrored by the Government’s response.

The March 2024 Procurement Update, sent out on the 26th  March 2024, confirmed that the regulations had been laid in Parliament on the 25th March 2024, 3 days following the publication of the Government’s response to the public consultation. Following the statutory instrument being laid, the draft has been published here: The Procurement Regulations 2024. The Cabinet Office’s March update specified that the consultation found that stakeholders were overwhelmingly supportive of the draft regulations, including with regards to proposals set out to improve transparency, and therefore no significant changes were necessary. 

The next step in the procedure is for the statutory instrument to be debated in both Houses.
