GP negligence claims

GPs have historically been required to purchase indemnity cover on an individual or group basis from a medical defence organisation or private insurer. On 1 April 2019 a new Clinical Negligence Indemnity Scheme for General Practitioners (CNSGP) came into force. This is a state indemnity scheme operated by NHS Resolution for general practice in England. The scheme covers clinical negligence liabilities arising in general practice in relation to incidents that occur on or after 1 April 2019. CNSGP will provide a fully comprehensive indemnity for all claims within its scope and the scheme extends to all staff working for general practice who are carrying out activities in connection with the delivery of primary medical services (including administrative staff and receptionists) from a primary care contract (a GMS, PMS, APMS contract, NHS Standard Contract related primary care services (Schedule 2L) or a sub-contract from any of these) or ancillary health services to primary care. Separate indemnity is still required to cover private work and other liabilities such as representation at inquest or in disciplinary proceedings.
